General Terms and Conditions (GTC)

§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders placed by consumers (§ 13 BGB) or entrepreneurs (§ 14 BGB) through the online shop my-booknooks.com.
(2) The purchase contract is concluded with:

(3) Deviating, conflicting, or supplementary general terms and conditions of the customer do not become part of the contract unless their validity is expressly agreed upon.
§ 2 Conclusion of Contract
(1) The presentation of goods in the online shop does not constitute a legally binding offer but an invitation to order.
(2) By clicking the button "Buy" / "Order with obligation to pay," you place a binding order for the goods contained in the shopping cart.
(3) Confirmation of receipt of the order follows immediately after sending the order by e-mail. The purchase contract is only concluded with our separate order confirmation or by delivery of the goods.
§ 3 Prices and Shipping Costs
(1) The prices stated on the product pages include statutory VAT and other price components.
(2) In addition to the prices stated, we charge shipping costs for delivery. The shipping costs will be clearly communicated to you again in the shopping cart system and on the order page.
§ 4 Payment Terms
(1) Payment can be made by credit card, PayPal, or other payment methods offered during the ordering process (e.g., Klarna, Sofortüberweisung, Apple Pay), if available.
(2) Payment of the purchase price is due immediately upon conclusion of the contract.
§ 5 Delivery and Retention of Title
(1) Delivery is made to the delivery address provided by the customer.
(2) The delivered goods remain our property until full payment of the purchase price.
§ 6 Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal.
(2) Further information on the right of withdrawal can be found in the withdrawal policy, which is made available separately on our website.
§ 7 Warranty (Liability for Defects)
(1) The statutory warranty rights apply.
(2) For consumers, claims for defects on new goods expire two years after delivery of the goods to the customer.
(3) If guarantees are given, the details are set out in the guarantee conditions attached to the respective delivered item. Guarantee claims exist independently of statutory claims/rights.
§ 8 Liability
(1) We are always fully liable for claims due to damages caused by us, our legal representatives, or vicarious agents:
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, as agreed,
- to the extent the scope of the Product Liability Act applies.
(2) For breaches of essential contractual obligations, the fulfillment of which enables proper execution of the contract in the first place and on which the contractual partner regularly relies (cardinal obligations), caused by slight negligence of us, our legal representatives, or vicarious agents, liability is limited to the foreseeable damage typical for the contract at the time of contract conclusion.
(3) Otherwise, claims for damages are excluded.
§ 9 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/.
(2) We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final Provisions
(1) The law of England and Wales (United Kingdom) applies, unless mandatory statutory consumer protection provisions of the country where the customer has their habitual residence (e.g., Germany or Austria) oppose this (principle of favorability).
(2) Should individual provisions of this contract be invalid or contradict statutory regulations, the remainder of the contract shall remain unaffected.
